ENVIRONMENTAL LAW
(LAWE-4003) - 3 UNITS

This is a study of federal laws designed to protect the environment. Ongoing debate over how to structure laws to address climate change serves as a case study for assessing various approaches to environmental regulation. The course focuses primarily on the National Environmental Policy Act, the Endangered Species Act, the Clean Air Act, the Clean Water Act and constitutional issues in environmental law (standing, takings, commerce clause). It also addresses administrative law issues relating to the interaction between Congress and federal agencies. The course also examines recurring themes in environmental law and policy, including cost-benefit analysis, valuing intangible environmental benefits, risk analysis, and ecosystem approaches.
