REPARATIONS: THEORY AND LAW
(LAWI-4200) - 2 UNITS

Reparations is not a novel concept in the United States, but it is a controversial one. The goal of this course is to determine what, if anything, distinguishes reparations from other forms of remedy: especially, distributive and corrective justice. We shall then explore various reparations proposals, historical and contemporary, successful and unsuccessful, covering a variety of groups that have demanded reparations; and examine the role the law has played in helping or hindering those proposals. We shall finally address what role reparations plays in the context of other demands for social justice or transformation.

We will examine these questions using a variety of sources, including academic writings, task force reports, and cases and statutes.
