ETHICS FOR PROSECUTORS AND DEFENDERS: DO NO WRONG
(LAWJ-4190) - 2 UNITS

This course will explore the special ethical rules and legal issues that confront lawyers who practice criminal law, whether they be prosecutors or defense attorneys. Prosecutors, by virtue of their positions representing the government, wield a tremendous amount of discretionary power not only to take away someone's liberty, but in some cases, his or her very life. Prosecutors have a duty to always seek justice and to avoid engaging in prosecutorial misconduct. Strict adherence to constitutional and statutory laws is paramount when it comes to charging someone with a crime; disclosing exculpatory evidence; selecting juries; and dealing with the media. Defense attorneys, likewise, must ensure they provide their clients with an adequate defense, avoid conflicts of interests, and maintain client confidentiality.
