ELECTRONIC DISCOVERY

For the next generation of lawyers, technical proficiency in e-discovery is not only advantageous, but essential to litigation practice. Today, a wealth of potential evidence is contained in e-mails, text messages, instant messages, and other electronic files. In fact, 90% of data is now preserved electronically, and two-thirds of the Internet population uses social media sites such as Facebook, Twitter and LinkedIn.

This course is an extensive and practical introduction to e-discovery. It will review emerging hot topics, including social media and privacy issues; preservation obligations and spoliation; privilege waivers; admissibility of electronic evidence; and ethical obligations. Students will participate in mock ?meet and confer? conferences and exercises in written discovery so that they are prepared to respond to and propound written discovery; take and defend depositions; and effectively counsel their clients as it relates to electronic discovery.
